Optional Consent to SMS Contact Through Tire Swing Support Call

Important: Receiving SMS messages is completely optional. You can continue to use Tire Swing Voice AI Product and receive full customer support through other channels whether or not you choose to receive SMS messages.

Purpose and Scope of SMS Communication

Tire Swing contacts consenting users via SMS as an additional channel of customer care. These messages may include, but are not limited to, appointment or inquiry confirmations, additional support instructions, status updates, reminders, and any further clarifications related to the Tire Swing Voice AI Product issue.

Message Frequency and Timing

  • SMS messages will be sent as needed to support your inquiry based on the conversation and until the matter is resolved.
  • There is no fixed frequency; however, messages will only be sent in connection with resolving or following up on your Voice AI and SMS experience.
  • Keywords: You can reply HELP at any time for instructions, or STOP to opt out of SMS support.

Standard Messaging Rates

Message and data rates may apply as determined by your mobile service provider. Please consult your carrier for additional details regarding any charges that may occur.

How to Opt-In to SMS Support

We offer two methods to provide consent for SMS communications:

Method 1: Post-Call Informational SMS + Opt-In

Step 1 (Informational Exemption):

We'll automatically send one purely transactional SMS (no marketing) immediately after your support call. You do not need to give permission on the call itself—this lone "informational" text is allowed under TCPA for customer-initiated calls. For example: "Tire Swing Support: Thanks for calling. Reply START to opt in to SMS support (reminders & Q&A), HELP for help, or STOP to opt out. Msg&data rates may apply." This message qualifies as a transactional, informational notice under TCPA and does not require prior written consent.

Step 2 (Affirmative Opt-In):

If you reply START, you're giving express written consent to receive all future SMS support messages. If you reply STOP (or don't reply), we will not send you any further texts.

Method 2: You Text Us First

Your first SMS to us cunts as written consent. We'll reply "Thanks for contacting Tire Swing Support AI. Reply START to confirm SMS support, HELP for info or STOP to opt out. Msg&data rates may apply. "

In both cases, you may opt out at any time by replying "STOP" to any message. Opting out of SMS communications will not affect your ability to receive support through other channels.

Opt-Out and Request for Assistance

  • You may withdraw your consent to receive further SMS communications at any time by replying with "STOP" to any message you receive from us.
  • For any assistance or questions regarding these messages, you may contact our team at privacy@tireswing.com.
  • Upon receipt of an opt-out request, we will promptly cease all SMS messaging related to your inquiry. Please note that opting out may limit our ability to provide ongoing updates for your support request.

Privacy and Data Use

  • Your phone number and any other personal information obtained during your call will be used solely for the purpose of demonstrating the Tire Swing Voice AI Product and will be handled in accordance with our Privacy Policy and Terms & Conditions.
  • We will not share, sell, or otherwise distribute your personal information to third parties for marketing purposes without your additional, explicit consent.

Documentation of Consent

Tire Swing maintains comprehensive records of all consent provided for SMS communications:

Call-Based Consent Records:

  • Transcripts of conversations with verbal consent are securely stored with timestamps
  • The date, time, and phone number of the initial confirmation text are recorded
  • Your reply confirming consent is stored as text evidence

SMS-Initiated Consent Records:

  • The initial inbound message from your phone number is recorded as consent documentation
  • The date and time of your first message and our automated response are logged
  • All subsequent message exchanges are stored to maintain a complete conversation history

Record Retention

We will retain a record of your consent and all related SMS Logs for up to 7 years, unless you request earlier deletion under applicable law.

Consent Acknowledgment

By replying START (or texting us first), you agree to receive SMS support messages. Consent is voluntary and not required to use our service.
